1. Introduction & Acceptance
These Terms & Conditions ("Terms") govern your use of the Yatharth Properties website, mobile apps, and related services (collectively, the "Platform"). The Platform and its services are provided by Yatharth Properties, a company operating from Bilaspur, Chhattisgarh, India. By using or accessing the Platform (including browsing listings, contacting agents, submitting data, or using any service), you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy, and any other terms, rules or policies posted on the Platform.
Users who do not agree to these Terms should not access or use the Platform.
2. Definitions & Scope of Services
Definitions:
- "Listings" — property advertisements, rental posts, and offers displayed on the Platform.
- "Owner" — the party who has listed the property or authorized the listing.
- "User" — any visitor, buyer, tenant, owner, agent or other person who accesses the Platform.
- "Services" — property marketing, lead facilitation, consultancy, valuation, legal assistance referrals, and other services offered by Yatharth Properties.
Scope: Yatharth Properties provides: marketing & listing services, lead matching between owners and prospective tenants/buyers, property verification assistance, consultancy on pricing & documentation, and referral/introduction services to legal, financial and inspection partners. Specific services requested by users may be subject to separate written agreements.
3. Marketing-only Notice — No Ownership Warranty
Important: Unless we explicitly state otherwise in a written agreement, all rental and sale listings on this Platform are published for marketing and facilitation purposes only. Yatharth Properties is a third-party facilitator and does not represent that it owns or directly controls listed properties.
When you contact us about a listing, our team will connect you with the Owner/authorized representative, assist in inspections and documentation, and — where applicable — charge fees for services disclosed at the time of engagement. You must independently verify ownership, title, occupancy rights, and encumbrances before completing any transaction.
4. Listing Standards, Moderation & Verification
Verification Process: Listings sourced by our team ordinarily follow a verification workflow (Document Audit → On-site Check → Owner Identity Confirmation). However, verification may vary by listing and third-party inputs.
User obligations: you must not rely solely on listing text or photos. Always physically inspect a property and request original documents (sale deed, title searches, property tax receipts, possession certificate, NOC(s) where relevant) prior to paying any amount.
Moderation: We reserve the right to remove or suspend listings which appear fraudulent, offensive, or that violate local laws (including RERA rules). If you suspect a listing is problematic, file a complaint via our WhatsApp help line or the contact form; we will investigate and may temporarily remove the listing pending verification.
5. Brokerage, Fees, Invoicing & Taxes
Transparent Fees
- Brokerage: Unless otherwise mutually agreed in writing, brokerage for rentals is typically one month's rent (or as disclosed by the agent) and for sales a standard percentage shall apply. Exact fee details are provided in written engagement or invoice.
- Service Charges: For specialised consultancy, legal introductions, documentation assistance or escrow facilitation, separate service charges apply and will be disclosed before services are rendered.
- Taxes: All fees are subject to GST and other applicable taxes as per Indian tax law. We will issue proper invoices for fees collected by Yatharth Properties.
6. Token Money, Deposits & Refunds
Token money (earnest money/bayaana) is a transaction matter between Buyer/Tenant and Owner. Yatharth Properties does not, by default, hold token money in escrow unless an explicit, written escrow arrangement is agreed and documented.
Token-money and refund policies are governed by the written agreement between transacting parties. Yatharth Properties will assist with documentation and receipts where requested, but will not be held liable for refunds unless we have expressly accepted custody of funds in writing.
7. Limitation of Liability & Disclaimers
To the maximum extent permitted by law, Yatharth Properties and its officers, employees and agents will not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising from your access or use of the Platform or reliance on listings — including but not limited to:
- Hidden structural defects, incorrect or outdated pricing in listings, or misrepresentations by third-party owners;
- Loss of opportunity, loss of profit, loss of data, or business interruption arising from transactions initiated via the Platform;
- Disputes over ownership, title, partition or succession matters not resolved via public records.
Our total aggregate liability for any claim related to these Terms shall not exceed the total fees paid by you to Yatharth Properties in the 12 months preceding the claim (if any).
8. Intellectual Property & User Content
The Platform and its content (design, text, images, software) are owned or licensed by Yatharth Properties and protected by law. You may not copy, reproduce or commercialise our content without prior written permission.
User Content: By uploading photos, descriptions or documents, you represent that you have the right to publish them and you grant Yatharth Properties a worldwide, royalty-free license to display, modify and use such content for platform operations and promotion. We reserve the right to remove user-submitted material that violates rules or is infringing.
9. Privacy, Data Use & Security
We process personal data according to our Privacy Policy. By using the Platform you consent to our collection, storage and limited disclosure of your data to service partners, legal authorities, and payment processors where required for service delivery, invoicing, or legal compliance.
We use reasonable technical and organisational measures to secure data, but cannot guarantee absolute security. Promptly report suspected misuse or breaches to our support team.
10. User Representations & Prohibited Conduct
When using the Platform you agree not to:
- Provide false or misleading information;
- Post unlawful, abusive, obscene, confidential or infringing material;
- Attempt to circumvent our agents or steal contact details for cold outreach;
- Use the Platform to impersonate another person or entity.
Violation may result in account suspension, legal action, and reporting to law enforcement.
11. Indemnity
You agree to indemnify and hold harmless Yatharth Properties, its officers, employees and agents from and against all claims, liabilities, losses, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Platform, or your negligent or wilful acts in connection with any transaction initiated via the Platform.
12. Complaints, Listing Removal & Takedown Procedure
If you believe a listing is fraudulent, illegal, or offensive, contact us immediately via WhatsApp at +91 98271 05662 or the support form. Please provide:
- Listing URL or ID
- Reason for complaint and supporting evidence
- Your contact details
We will acknowledge receipt within 48 hours and may temporarily remove the listing pending verification. For urgent safety concerns, notify local authorities in parallel.
13. Dispute Resolution — Negotiation, Mediation & Arbitration
We prefer to resolve disagreements amicably. The dispute procedure is:
- Negotiation: Parties will attempt good-faith negotiation for 30 days after written notice.
- Mediation: If negotiation fails, parties shall refer the dispute to mediation by a mutually agreed mediator (local mediation centre in Bilaspur where available).
- Arbitration: Any unresolved dispute shall be finally settled by binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bilaspur, Chhattisgarh. The language of arbitration shall be English or Hindi as agreed.
If arbitration is not available or enforceable, the parties agree that the courts of Bilaspur, Chhattisgarh shall have exclusive jurisdiction. This clause does not prevent either party from seeking urgent equitable relief from courts if required.
14. Governing Law & Consumer Rights
These Terms are governed by the laws of India. Nothing in these Terms shall limit your rights under Indian consumer protection laws (including the Consumer Protection Act, 2019) where such rights are mandatory and cannot be waived.
For users who are consumers, statutory rights under consumer protection law remain available in addition to the dispute resolution procedure above.
15. Force Majeure
Yatharth Properties will not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, government actions, natural disaster, pandemic, strikes, or interruptions of telecommunications services.
16. Changes to Terms, Suspension & Termination
We may modify these Terms at any time. Material changes will be posted with an updated "Effective Date" at the top of this page; continuing to use the Platform after changes indicates acceptance. Users are responsible for reviewing the Terms regularly.
We reserve the right to suspend or terminate access to the Platform if you breach these Terms or where required by law.
17. Miscellaneous Provisions
- Severability: If a provision is held unenforceable, the remainder of the Terms remain in force.
- Assignment: Yatharth Properties may assign its rights to affiliates or in connection with a sale. You may not assign your rights without prior written consent.
- Whole Agreement: These Terms and referenced policies are the entire agreement between you and Yatharth Properties regarding the Platform.
- Language: These Terms are in English. If translated, the English version prevails in case of conflict.
